Our U.S. Constitution X 3: Three Times Over
Our United States has a written
Constitution, and its TEXT provides a framework for governing our country. The
original document is housed in Washington, D.C.
Number One Constitution
This historic parchment is a viable hard copy with complete text. But
the text is discrete in its general statements. Because some segments are
ambiguous, various “readings” of their intended meaning have evolved. Further, the philosophies and intentions of its authors create a need for
literal interpretation.
When looking deeply into the written text, some parts are
not clearly certain what they mean. When relying on other sections, what its
authors intended as rules of governing this nation become fluid.
Number Two Constitution
The Constitution included a Judicial Branch of government. At first,
the federal court system was small and weak. Then, it grew more and more
powerful, until it accumulated a vast book of law cases. Over the centuries,
Supreme Court rulings have created an unwritten Constitution. From the vast book of intertwined rulings, on any given, the Supreme Court
can write its judgment.
Today’s Court is allowed to make legal judgments that whatever the
Court says the Constitution says is what the written text means.
Number Three Constitution
An invisible Constitution operates around every person. The Invisible
Constitution is a contemporary interpretation, which is reinterpreted.
Constitutional language gets redefined through powerful events in U.S.
History. Its text becomes parsed and layered.
Specifically, Amendments are adjusted and redefined by the Supreme
Court. Congress writes many laws justified by isolated clauses; one its
favorites is “the general welfare” clause. Presidents, from Abraham Lincoln
to Barrack Obama, rely on the “necessary and proper” clause. Plus, there are
a garden variety of other general rule sections.
The Invisible Constitutions allows the federal bureaucracy to
enlarge federal agencies, as well as build a shadow government. Congressional offices are so over staffed with vague personnel assignments. The Justice Department has tiers of legal schools selling brand of
Constitutional interpretation sating it is what they say it means.
The gaps and ambiguity within the original text has opened the door for
constant generalizations. Its text is an ever moving target or a partial
constitution with fluid structures. Congresses federal regulations, national laws
signed by presidents, and an evolutionary Supreme Court generate extra
textual rules of governing. At this point in American government, there is
no self regulation! None of the three branches has any obligation, or a
sense of duty, to explain their actions.
THE GOOD NEWS is “we the people” have
a legal right of amend the written Constitution. Smarter America leads this
campaign for good citizens and love of country.
Every one of the three
forms of Constitution is based on the Consent of the Governed. We who vote,
pay taxes, and reside in communities have the right to say how we want
government run. We can restrict our ever expanding federal
government. Let us have a Constitutional convention for the sole purpose of
repealing the Seventeenth Amendment. Article IV, Sec.4 reads, “The United
States shall guarantee to every state a Republican Form of Government.”

The bigger our
federal bureaucracy grows, the greater the corruption.
Compelling Benefits for
undoing five decades of federal power are:

Restore the
original intent of U.S. Senators: an advisory board

Cut federal
bureaucracy in the Senate and reduce committees, spilling into
the Executive Branch.

Restore
States guaranteed powers under Amendment Ten.

Give
the voters a more direct and powerful voice in who their
Senators shall be. ( At present, Senators disappear for six years,
until next election cycle.)

Make
Senators accountable to their State Legislators, who have the
ability to recall them.

The people's
disenchantment with their Senator would be aired locally! The
distance for affirmative action is as close as the state capitol and
its legislature. Senators would represent their state and the
people's need within that state.

More Money to the States:
An important component that will prove beneficial to
the several states is taxes! Each State needs money; better to keep
monies at home than to send to the federal government in far away
D.C. Allow the voters with in each state to elect officials who can
best allocate tax revenues for their individual state
Money is the key factor in growth and it is the key
motivator for the several states. Each State needs money, and they
need it yesterday. The repeal of the 17th, as a
stand-alone Constitutional Amendment, gets them no money. But a
combination where the states control tax money as well as their U.S.
Senator necessitates the power and the programs returning to the
states. Each States would become a capitalistic entity, competing
with one another for business and people’s purchasing power. From a
completive, capitalistic perspective, State would reduce their size
and scope of their governments

All politics
is local! Prior to ratifying the Seventeenth Amendment in
1913, citizens saw more of their Senators. They voted for their
choice, and state legislatures appointed the popular choice.. The
best know example is the famous Lincoln and Douglas debates; Lincoln
lost to Douglas, who was appointed to the Senate by the Illinois
State legislature.
Call for a Constitutional Convention
to repeal the Seventeenth Amendment through state legislatures.
